Terms of Service

1. The Service

Gongxu AI is an AI-powered process-analysis platform. After you upload a work video, the system automatically splits it into work steps and, depending on what you choose, produces the following documents: work instructions (SOP), process analysis (a process chart with ECRS improvement suggestions), an ergonomic assessment (posture load rated with the REBA method) and a safety analysis (job safety analysis using the LEC method plus a KYT hazard-prediction report).

• These documents are generated automatically by AI from the video content. They are drafts and may contain errors, omissions or content that does not fit your workplace.
• You can edit steps and content on the platform, export PDF / Excel files and regenerate documents within a task.
• We keep improving our models and features, so the format, content and available features may change between versions.

2. Accounts and eligibility

• You must be at least 18 years old and have full capacity for civil conduct to register for and use the Service.
• As required by the Cybersecurity Law of the People's Republic of China, you must verify a genuine mobile number or email address when you register. Provide accurate and complete information and keep it up to date.
• You are responsible for keeping your password and verification methods secure, and for all activity under your account. If you notice unauthorized use, change your password in Settings immediately and let us know.
• One person may hold only one account. The account is for your own use and may not be given away, lent, rented, transferred or sold. Do not use multiple accounts to claim sign-up points more than once or to get around usage limits.

3. Your content and the license you grant us

The videos you upload, the text you enter and the documents the Service produces and you edit (together, "Your Content") remain yours or the original rights holder's.

• To provide the Service, you grant us a license, for the duration of the Service, to store, copy, transcode, capture frames from and analyze Your Content, and to send the necessary frames and text to the AI model providers we engage for inference. This license is used only to deliver and improve the features you use.
• We do not use your videos or documents to train AI models, and we do not make them available to other users.
• You represent and warrant that you hold the necessary rights to Your Content; that the people who appear in your videos have been informed and have consented to being filmed and analyzed as required by law; and that Your Content does not infringe any third party's intellectual property, privacy, portrait or other rights and contains nothing prohibited by law.
• For the personal information of workers who appear in your videos, you are the personal information handler and we process that information only as your entrusted party, on your instructions.

4. Acceptable use

When using the Service, you must not:

• create, copy, publish or distribute information whose content is prohibited by law, such as content that endangers national security, undermines social stability, or is obscene, violent, terrorist, insulting or defamatory;
• upload content that is infringing, contains malware or is unrelated to work analysis;
• upload footage in which people can be identified without their consent;
• interfere with, damage or attempt to gain unauthorized access to the Service, our servers or other users' data;
• reverse engineer or decompile the Service, or scrape content with automated tools;
• circumvent point deductions, usage limits or security mechanisms;
• resell, rent or offer the same service to third parties on top of the Service without a written agreement with us;
• present AI output as a legally required document signed off by a qualified professional when it has not actually been reviewed;
• use the Service or its output to evaluate, rate, discipline, or make employment or other decisions about an identifiable individual. The output describes work methods and workstations, not people.

5. Points, payment and refunds

• The Service is billed in points. You receive trial points when you sign up and can buy point packs when you need more. The number of points each feature uses is shown in the interface before you run it.
• Point packs have no monthly fee and never auto-renew. Each batch of points (purchased or free) is valid for one year from the date it is credited; points expiring soonest are used first, and points not used by then expire automatically. Points are non-transferable, cannot be exchanged for cash and cannot be moved between accounts.
• If an analysis or document generation fails for reasons on our side, the deducted points are refunded automatically.
• Online payments are processed by a third-party payment provider. Your payment account details are handled by the provider and never reach us. Payments may also be subject to the provider's own agreement.
• Points are digital goods delivered online and are delivered as soon as payment is complete. Under Article 25 of the Law of the People's Republic of China on the Protection of Consumer Rights and Interests, and as confirmed by you at the time of purchase, the seven-day no-reason return right does not apply. If points were deducted twice or never credited because of our error, contact us and we will fix it. See our Refund Policy for refund conditions and how to request one.
• Prices may change. Changes apply only to purchases made after the change and do not affect points you already hold.

6. Changes to the Service, beta and availability

• The Service is currently in public beta. Features and the interface may be adjusted, added or removed at any time.
• We do our best to keep the Service stable, but we do not guarantee that it will be uninterrupted, error-free or suited to your specific needs. We may suspend the Service for maintenance, upgrades or events beyond our control.
• We reserve the right to modify or discontinue all or part of the Service after reasonable notice. If a discontinuation affects points you have purchased, we will offer a reasonable compensation or refund arrangement.

7. Intellectual property

• The Service, including its software, interface design, report templates, trademarks and text, and all related intellectual property rights belong to us or to our licensors. Except as expressly permitted by these Terms, you may not copy, modify, distribute or otherwise exploit them.
• You are free to use the documents you produce with the Service for your internal operations and business purposes.
• If you give us feedback or suggestions, you agree that we may use them to improve the Service without restriction or compensation.

8. Third-party services

The Service relies on the following third-party services, whose agreements may also apply to you:

• AI model inference: Alibaba Cloud Model Studio (mainland China region);
• Cloud storage: Alibaba Cloud Object Storage Service (OSS, mainland China);
• Online payments: a third-party payment provider.

We are not responsible for the availability or content of third-party services. See the Privacy Policy for details on how data is processed.

9. Disclaimers

• The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no express or implied warranties about the Service or its AI output, including warranties of merchantability, fitness for a particular purpose and non-infringement.
• AI-generated work instructions, process analyses, ergonomic assessments and safety analyses are for reference only. They are not professional opinions issued by registered safety engineers, ergonomists or legal advisers, and they do not replace risk assessments, work-safety inspections or audits required by law.
• Before using AI output for shop-floor operations, training, safety management or any other decision, have it reviewed by qualified personnel. You bear the responsibility for how it is used.

10. Limitation of liability

To the fullest extent permitted by law:

• we are not liable for any indirect, incidental, consequential, punitive or special damages, including lost profits, loss of data, business interruption, personal injury or property damage, even if we were advised of the possibility of such damages;
• our total liability to you in connection with the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim;
• where mandatory law provides otherwise for the liability of business operators, that law prevails and the limitations above do not apply to that extent.

11. Indemnity

If a third party brings a claim against us, or we suffer loss, because you breached these Terms, Your Content infringed someone's rights or you used the Service unlawfully, you agree to indemnify us and hold us harmless, including for reasonable legal fees.

12. Termination

• You can delete your account at any time under Settings → Account → Delete account. Your tasks, videos, reports and remaining points are then deleted and cannot be recovered, and your mobile number and email address are released so they can be registered again.
• If you breach these Terms, or if the law requires it, we may suspend or terminate your account and may decline to refund points.
• Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, indemnity and governing law) continue to apply after termination.

13. Governing law and disputes

The formation, validity, interpretation, performance and dispute resolution of these Terms are governed by the laws of the People's Republic of China (for the purposes of these Terms, excluding the laws of the Hong Kong and Macao Special Administrative Regions and the Taiwan region). Any dispute arising from these Terms or the Service should first be resolved through friendly negotiation. If that fails, either party may bring an action before the people's court with jurisdiction over our place of domicile. Where mandatory law gives consumers greater protection, these Terms do not limit it.

14. Changes to these Terms

We may update these Terms from time to time. We will announce material changes on the website or by email before they take effect. The updated Terms take effect on the "Last updated" date shown on this page. Continuing to use the Service after a change means you accept the updated Terms; if you do not agree, stop using the Service and delete your account.
